Your contract is with owners Karen & David Holtham (referred to as “we”, “us” and “our” in these booking conditions) for the property known as Apt A12 Quinta Da Barracuda (“the property”).  The terms (“client” or “you”) are references to the person making the booking and all members of the holiday group.

Booking

  • The property is offered as a holiday rental subject to written confirmation by us to you once the completed booking form and initial 25% non-refundable deposit is received.
  • We advise you therefore not to book flights until your written confirmation is received confirming dates, as only then will any contract between us exist.
  • The balance will then be due 8 weeks before the arrival date, a reminder will be sent and if no money is received by the due date we then reserve the right to give notice in writing that the reservation is cancelled.
  • For reservations made within 8 weeks of arrival date then full payment of the rental hire is required at the time of booking.
  • We reserve the right to refuse any bookings prior to the issue of written confirmation, any money paid will be refunded without delay.

Cancellation

  • In the unfortunate event that you need to cancel your booking after full payment has been received we reserve the right to retain the full payment,  refunds will only be given if we have been able to re let the property,  this will be subject to an admin fee @ £25.
  • Circumstance may arise that are out of our control and if we find it necessary to have to change your booking or at worst cancel it, we will notify you as soon as possible.  If it is necessary, all money paid by you will be refunded, however every effort will be made in the first instance to find alternative accommodation of a similar standard.
  • You are strongly recommended to arrange comprehensive travel insurance to include cancellation cover and to have full cover for the group’s personal belongings as these are not covered by our public liability insurance.

Deposit

A security deposit @ £200/€200 will be held against loss of keys or entry fobs and damage to the property, its contents as well as additional cleaning costs incurred due to excessive misuse.  We promise to refund the deposit within one week of your departure less any deductions in accordance with the conditions stated above and will make account for any such deduction, however the deposit held by us shall not limit your liability.

Arrival/Departure

  • The apartment will be made available from 2pm on day of arrival and the apartment must be vacated no later than 10am on the day of departure.  We are not obliged to offer accommodation before the stated time and you are not entitled to remain in the apartment after the stated time unless the property is unoccupied and is agreed by prior arrangement.
  • If your arrival is to be delayed please contact us a soon as possible so that we can inform our representative meeting you at the apartment to make alternative arrangement.  Failure to do so will mean you may not be able to gain access to the apartment. Contact details are on our booking confirmation. However if we have arranged the airport transfer you will have received instructions and contact details from our representative direct, so it would be advisable in the first instance to contact them regarding your delay.
  • However if you have not arrived by midnight of the following arrival date and no contact has been received from you, then we may treat your booking as being cancelled.

Accommodation

  • The apartment is rented on a self-catering basis, therefore the rental charge does not include maid service or linen change.  However this can be arranged at an additional cost to be agreed directly with our property manager.
  • List of facilities and equipment that are found in the apartment and at Quinta Da Barracuda are displayed on our website.
  • We operate a no smoking policy in the apartment and ask that this is respected.
  • Pets are not permitted in apartment.

Our Liability

  • We shall not be liable for loss of services to the property that are beyond our control. i.e. water/gas/electricity or loss of internet access.
  • We shall not be liable to you for any breakdown of appliances or equipment failure however every attempt will be made to get these repaired or replaced as soon as possible to limit any inconvenience caused.  Please note however that it may not be possible to rectify the problem during your stay especially during the high season as tradesmen are often very busy.
  • We shall not be liable for any loss, damage or injury caused by adverse weather conditions, riot, war, strikes or other matters that are out of our control.
  • Our liability to you will not exceed the amount paid to us from you for the rental period. However this does not include or limit in anyway our liability caused by our negligence, fraud or fraudulent misrepresentation or for any matter which it would be illegal for us to exclude or to affect your statutory rights.

Your obligation

You and your group agree to the following:

  • To abide by the regulations of the condominium known as “Quinta Da Barracuda” copy of which are on the website
  • To respect and look after the furnishing and equipment in the apartment and to leave it in a clean and tidy condition.  We reserve the right to recover cleaning costs if the property is left in an unacceptable condition
  • Not to cause any willful damage to walls, windows, doors, furniture, linen or appliances.  Any damage will be deducted from your deposit
  • Not to cause any disturbance or annoyance to other guests or neighboring properties.
  • To make every effort in safeguarding your own personal belongings as we accept no liability of loss or damage of such property and is not covered by our own public liability insurance.
  • To have comprehensive travel insurance to at least cover cancellations, flight delays and medical expenses that includes evacuation and repatriation.  Failure to do so is at your own risk.
  • Not to have more people than those stated on your booking form stay in the property.  To notify in advance of any name changes and supply their details as required on a separate booking form.
  • Not to allow any pets of any kind in the apartment
  • To allow reasonable access to the property during your stay to carry out essential repairs.
  • To supervise children at all times paying particular attention to balconies, swimming pools, lifts, stairs and the property in general.
  • To notify either our property manager or ourselves without delay of any problems or appliance failure so that this can get rectified as soon as possible.

Data Protection

Every effort will be made to protect your personal data and will not be passed onto any third party other than those involved in your accommodation & travel arrangements. By accepting this contract you agree that contact details will need to be sent to our property manager.  It is also a requirement of Portuguese law that they are notified of all persons entering the country for which those details asked for on your booking form will be reported to them using their own secure website.  Failure to provide these details or disagreeing to have those details reported means we are unable to accept your booking.

Law

The contract shall be deemed to have been made in the United Kingdom and is governed by English Law covering the law of England and Wales. All matters concerning this contract will be governed by this law whether you live in the United Kingdom or a non-resident and we both agree that any dispute or matters arising in connection with this contract may be dealt with by the courts of England and Wales.
